There is no provision in the Act that specifically relates to street naming and numbering.  Local authorities in England have a general power of competence under Section 1 “to do anything that individuals generally may do”. 

In our view this is not of assistance because an individual cannot generally name or a number a street.  We have given thought as to whether Section 17 of the 1925 Act and Section 5 of the 1939 Act give a power to an individual to name a street.  We consider these Sections give a power to nominate a name but it is the local authority – by not exercising its power to object – that formally lets the name go forward.

At the very most it might allow a local authority in one capacity to nominate a name under the 1925 Act or 1939 Act but we are not convinced that is a correct use of the general power.
