Conceivably a local authority in Wales, could still use the “well-being power” under Section 2 – “power to do anything which they consider is likely to [promote or improve the economic, social or environmental well-being] of their area”. The well-being power no longer applies in England following the Localism Act 2011. We have some difficulty in rationalising an environmental argument although we could see how an economic or social argument might be formulated. However, the power is subject to restrictions in all other legislation and so there seems little point using the “well-being power” when there is express legislation under whichever of the 1847, 1907 or 1925 Acts applies in the particular administrative area following the Local Government Act 1972.
